Our College hosted Assistant Professor Dr. Hussein Obaid Shawat, a professor of civil law at the College of Law at Al-Qadisiyah University, to participate in a committee discussing a master’s thesis on “Guiding Sources of Civil Judges – A Comparative Study,” submitted by student Mustafa Ali Abdul Husseini.

The study aimed to understand the concept of guiding sources of civil judges, the importance of using them, their types, the determinants of resorting to them, and their impact on building the legal foundation and preserving the legislative and judicial system.

The study concluded that guiding sources represent an effective tool for bringing legislative texts closer to reality and transforming them from an abstract to a concrete form. Furthermore, the philosophy of resorting to guiding sources of civil judges is based on the inherent deficiency in legislative texts, which in turn leads to the inability of legislative texts to keep pace with emerging and evolving situations.
